Election of Chairman

Minutes:

RESOLVED - That Councillor I Thomas be elected Chairman of the Sub-Committee for the meeting.

Minutes:

An apology for lateness had been received from Councillor Spooner.

9.

Substitute Councillors

The Chief Executive will report any notifications received prior to this meeting regarding the attendance of substitute Councillors for the named members of the Sub-Committee.

 

Minutes:

Councillor I Thomas was present as substitute for the vacancy position on the Sub-Committee.

Declaration of any Interests by Councillors or Officers

TO RECEIVE any declarations for the following in so far as they relate to the business for the meeting:-

Voluntary Announcements of Other Interests not required to be disclosed as DPI’s or OSI’s, ie announcements made for transparency reasons alone, such as:

         Where a Councillor knows a person involved, but does not have a close association with that person, or

Minutes:

During the discussion of the periodic report on planning enforcement, Councillor Nolan made a voluntary declaration that a family member lived near one of the sites that was discussed.

TO RESOLVE – That under Section 100(A)(4) of the Local Government Act 1972, the press and public be excluded from the meeting during consideration of the following item of business on the grounds that there would be disclosure of exempt information as defined in Part 1 of Schedule 12A of the Act or the Freedom of Information Act or both

Local Government Act 1972).

 

TO CONSIDER the report of the Head of Planning

 

Minutes:

(This report is exempt from publication because it involves information which reveals that the authority proposes to give under any enactment a notice under or by virtue of which requirements are imposed on a person: or to make an order of direction under enactment. As such the exemption under paragraph 6 of Schedule 12A of the Local Government Act 1972 applies).

 

The Sub-Committee considered the report of the Head of Planning which set out details regarding the progress on enforcement cases where there had been significant breaches of planning controls.

 

The Deputy Team Leader and Planning Enforcement Officer took the Sub-Committee through the cases and updated the Councillors on the current position regarding each case.

 

The suggested approach to the cases now referred to was supported by the Sub-Committee.

 

The Sub-Committee were concerned that the officers had had some technical difficulties in reviewing some archived maps and photos and they were supportive of the suggested remedy.

 

The Sub-Committee discussed how the Regulation of Investigatory Powers Act affected planning enforcement investigations and officers agreed to provide an update at the next meeting.
